Over the Rainbow Desserts, LLC CUSTOM ORDER - TERMS AND CONDITIONS

Your cake/custom cake/desserts order is subject to the following Terms and Conditions. 

Please read them carefully. By placing your cake/dessert custom order, you accept these Terms and Conditions. 

Over the Rainbow Cupcakes and Desserts is not responsible for custom cakes, cakes, donuts, sheet cake, pies, cupcakes, macarons, or any desserts once they have been delivered, set up or picked up from the bakery. No refunds no exceptions. Your initial deposit is non-refundable. In the event of a pandemic situation, your deposit is non-refundable. No exceptions.

NOTE for Outside Set up and Deliveries 

Client understands that Over the Rainbow Desserts is not responsible for the condition of products following outdoor set­up. Due to the effects of outdoor weather conditions, table on un-level ground, wind blowing, undesirable atmospheric items (e.g., dirt, leaves, or branches), sunlight, insects and other wildlife, it is understood that products such as icings, fillings, cake decorations, may not hold up and cannot be insured past satisfactory delivery. No refunds, no exceptions.

When cakes, desserts are picked up at the bakery, the customer assumes full liability and responsibility for the condition of the cake/desserts once the items leave Over the Rainbow Desserts bakery possession. No refunds, no exceptions.

Please note that colors and design of actual cake may vary slightly from pictures or mock-ups, including AI generated photos, due to the nature of digital and edible components and pictures. Cake design may not be exact and the bakery has creative control.

Over the Rainbow Desserts is not responsible for any damages to cakes and desserts caused by a guest, caterer, or any other person not employed by Over the Rainbow Desserts Cupcakes. Client agrees to make arrangements for a proper and secure environment for the cake and desserts, once picked up from bakery or delivered.

Client assumes full responsibility for making sure all nonedible cake décor, including but not limited to, sugar flowers, are removed from the cake before it is cut and served. Sugar flowers are made from edible materials, but are not intended for consumption as wires are added for strength and flexibility to achieve a more natural look.

DO NOT EAT DÉCOR.

If you are using fresh flowers on your cake, your florist is responsible for providing the flowers and ensuring that they are safe to place on an edible cake. It is important to note that not all flowers are safe to come into contact with food, so please discuss these options with your florist. The florist is responsible for placing the flowers on the cake. 

Flowers like hydrangeas and baby's breath, while popular in bouquets, are actually toxic. Even if you aren't eating the actual flowers, just contact with the buttercream frosting you will eat could be dangerous. 

Over the Rainbow Cupcakes and Desserts is not to be held liable for the client's florist décor.

Over the Rainbow Cupcakes and Desserts promises a product of high quality and service, but is not liable for unforeseen circumstances, including but not limited to inclement weather, transportation problems, illness, accidents, labor disputes or strikes, and other causes beyond reasonable control. A delay in transit shall not constitute grounds for a discount or refund. By paying for the cake, the customer agrees that certain creative changes may be made to your final design, including for the sake of stability, structural integrity or other certain emergencies.

No refunds, no exceptions.

What happens if a customer forgets about their order?

For pickups: In the event that you forget to pick up your order we will try our best to give you a call, however we cannot guarantee any reminders. We are a busy bakery and it is the customer's responsibility to pick up when we have designated. We do not issue refunds for orders that are already made and not picked up by customers.

If we give you a call and you cannot get here by the time we close we will certainly hold your cake/desserts for pick up the following business day we are open. If it has been more than 2 days and we have not heard from you regarding your pickup we will unfortunately have to discard your order and no refunds will be given. No exceptions.

NOTE THE BAKERY CLOSES AT 4PM SHARP.

*Any late pickups will incur a $30 PER 30 min late fee, ONLY IF there is an associate to stay past closing*
